Registration in the Register of NATURAL and LEGAL Persons in Sport

Who is obliged to be registered in the Register of NATURAL Persons in Sport?
Natural persons who carry out sports activities as
a) athlete (amateur, professional),
b) sports expert (coach, instructor, other sports expert).
NOTE: Masseur / sports masseur / wellness worker are regulated professions according to another legal regulation that is not within the competence of the Ministry, so we do NOT register them in the Sports Information System.
Who registers data in the Register of NATURAL Persons in Sport?
a) A sports organisation, if a natural person is a member of a sports organisation
b) The Ministry, if the natural person does not belong to any sports organization (Video tutorial)
How is the registration in the Register of NATURAL Persons in Sport carried out?
a) Sports organization through authorized access to the Sport Information System (Sports Organization Administration in the Sports Information System)
b) The Ministry, on the basis of the request of a natural person, according to the following procedure:

IMPORTANT:
The mere entry in the Register of Natural Persons in Sport does NOT entitle a sports expert to carry out his activities as a business. If a sports expert wants to do business, he must visit the district office, through the Trade Licensing Office, which performs the tasks of the Single Point of Contact, where he applies for the registration of a business license.

Who is obliged to be registered in the Register of LEGAL Entities in Sport?
a) sports organisations (any legal entity whose subject of activity or the aim of its activity is sports activities, except for public administration bodies, for example: national sports associations, sports clubs, operators of sports facilities, providers of coaching and lecturing services in sport),
b) recipients of public funds in the field of sport (in addition to legal entities referred to in letter a), also cities, municipalities, local self-governing units, their budgetary and contributory organizations, etc.),
c) providers of funds from the state budget for sports activities (ministries, the Office of the Government of the Slovak Republic, etc.).
Who registers data in the Register of LEGAL Entities in Sport?
The relevant legal entity pursuant to letters a) to c) shall enter the relevant data into the Register of Legal Entities in Sport.
How is data entered into the Register of LEGAL Entities in Sport?
You can apply for access to the Sports Information System for the purpose of registering data on a legal entity in the Register of Legal Entities in Sport on the Portal for Submitting Applications in Sport.
After filling in and sending the application electronically, it is also necessary to print it out and deliver it signed by the statutory body of the legal entity to the address of the National Sports Centre (House of Sport, Olympic Square 1, 831 04 Bratislava).

Business of a sports expert as a natural person
Legislation
The activity of a sports expert (coach, instructor, other sports expert) is regulated as follows:
Since 01.01.2017, it has been a business (Section 6 (3) (a) of Act No. 440/2015 Coll. on Sport and on the Amendment of Certain Acts), SKNACE: 93190 – Other sports activities.
From 01.01.2016 to 31.12.2016 it was another self-employed activity (Section 6 (2) (e) of Act No. 595/2003 Coll. on Income Tax).
Until 31.12.2015, it was a regulated trade (Act No. 455/1991 Coll. on Trade Business).
In order for a sports expert to obtain a business license, he must first be registered in the Register of Natural Persons in Sport as a sports expert. However, this registration does not make him an entrepreneur (he does not have a license to do business). He/she only obtains the authorization to perform the activity of a sports expert on the basis of a contract on the performance of the activity of a sports expert, on the basis of an employment relationship or a similar employment relationship, as a volunteer and without a contract.
The authorization to perform the activity of a sports expert as a business arises only on the day of registration of this authorization in the Register of Legal Entities, Entrepreneurs and Public Authorities on the basis of its application for registration. Based on the amendment to Act No. 440/2015 Coll. on Sport and on Amendments to Certain Acts from 01.01.2020, it is possible to register a business license, suspend a business, terminate a business only at the district office, through the Trade Licensing Office, which performs the tasks of the Single Point of Contact. The Single Point of Contact will issue a business license to a sports expert, assign him an ID number and register him in the Register of Legal Entities, Entrepreneurs and Public Authorities.
A change of business name, a change of place of business or a change of permanent / temporary residence is carried out by the Ministry through an application – Formular_zmena_zapisu_sportoveho_odbornika. It is not possible to change the permanent/temporary residence if the sports expert is competent to the sports organization that made his or her entry into the Sports Information System.
Business of a sports expert as a legal entity
If a sports expert (coach, instructor, other sports expert) wants to carry out his or her activity as a business through a legal entity (e.g. its own limited liability company), this legal entity must have the following subject / activity in its subjects of business/activities: "sports activity according to Section 3 (a) of Act No. 440/2015 Coll. on Sport and on Amendments to Certain Acts" (registration of this activity is not conditional on any special document, no authorization or permit is required, no responsible person needs to be documented). This legal entity must then be registered in the Register of Legal Entities in Sport (a legal entity that performs sports activities is a sports organization). If professional competence is required to perform the activity of a sports expert, the relevant legal entity (sports organization) is obliged to ensure the performance of this sports activity by a professionally qualified person (according to the law, the activity of a sports expert cannot be performed by a legal entity, but only by a natural person). A legal entity is also obliged to register in the Register of Natural Persons every sports expert who will carry out activities on its behalf.
Such a legal entity (sports organization) is subsequently subject to all other laws related to the business of legal entities (taxes, levies, schwarz system, ...).
Business of a professional athlete
The authorization of a professional athlete to perform sport as a self-employed person (self-employed person) arises on the day of registration of the professional athlete in the Register of Natural Persons in Sport. Such an athlete must be assigned his ID number and must be registered in the Register of Legal Entities, Entrepreneurs and Public Authorities.
It follows from the above that a sports organization for which a natural person will perform the activity of a professional athlete on the basis of a contract for the professional performance of sport or another contract (if he performs sports for a sports organization as a self-employed person) is obliged to register a professional athlete in the Register of Natural Persons in Sport by registering him with the activity of a professional athlete with the legal title of a self-employed person. Subsequently, it immediately informs the Ministry about the registration via the form – Formular_zapis_ profesionalneho_sportovca. On the basis of this form, the Ministry assigns an ID number to the athlete and informs the relevant district office about it through the Trade Licensing Office at the registered office of the professional athlete, which delivers a business license to the professional athlete and informs the interested authorities.
If a professional athlete is already registered in the Register of Natural Persons in Sport with a legal title other than self-employed, it is necessary to first terminate this activity and then enter it as a new activity – professional athlete with the legal title of self-employed.
It is possible to suspend business and terminate business only at the district office, through the Trade Licensing Office, which performs the tasks of the Single Point of Contact.
Summary of the procedure:
1/ The sports organization for which the natural person will perform activities will register the natural person in the Register of Natural Persons in Sport as a professional athlete with the legal title of self-employed person.
2/ The sports organization shall immediately inform the Ministry of this registration by means of a duly completed form.
3/ The Ministry assigns an ID number and informs the district authorities about it through the Trade Licensing Offices.
4/ District authorities through trade licensing offices will issue a license to do business to a professional athlete as a self-employed person.
5/ District authorities shall inform other interested authorities of the issuance of the authorisation.
