Recommended procedure for filing a complaint with the Chief Controller of Sport

The Chief Controller of Sport performs professional control in sports organizations that are recipients of funds from the state budget or recipients of sponsorship. In the performance of his activities, the Chief Controller of Sport proceeds in accordance with the provisions of a special regulation. According to Section 61 (6) of Act No. 440/2015 Coll. on Sport and on Amendments to Certain Acts, as amended (hereinafter referred to as the "Sports Act"), "Section 14 applies to the performance of the control activity of the Chief Controller of Sport". The Chief Controller of Sport performs control activities on the basis of:
(a) on its own initiative;
b) the initiative of the body of the sports organisation,
c) a complaint of a person belonging to a sports organization,
d) of the Ministry's initiative. The Chief Controller of Sport does not carry out inspection activities on the basis of an anonymous complaint. The Chief Controller of Sport points out that the order of the inspection activity is determined in accordance with the plan of inspection activities. New suggestions will be included in the control activities only after the tasks resulting from this plan have been fulfilled, with priority given to suggestions directed to national sports associations. Complaints directed against sports clubs will primarily be forwarded to the controller of the relevant association or other bodies of the given association (or sports organization). The Chief Controller of Sport recommends first of all to file a complaint with the controller of the relevant sports organisation/controller of the national sports association. There are no specific deadlines for the performance of inspection activities. From the point of view of the procedural procedure of the HKŠ, the performance of inspection activities is not subject to the Act of the National Council of the Slovak Republic No. 10/1996 Coll. on Inspection in State Administration, as amended, nor to the general regulation on administrative proceedings (see Section 101 of the Sports Act)

The Sports Act (Act No. 440/2015 Coll.) does not define the form or mandatory requirements of a motion to initiate proceedings. The text of the submission should be clear and understandable.  The submission of a complaint must be based on concrete and substantiated evidence. We recommend that the submitter should contain at least the following facts:

Subject of submission :

The text of the complaint must be clear, understandable and must include:
a) proving the applicant's affiliation to a sports organisation pursuant to Section 3 (k) of Act No. 440/2015 Coll. on Sport and on Amendments to Certain Acts, as amended (hereinafter referred to as the "Sports Act"), affiliation to a sports organisation based on

  1. by participating in a competition for a sports organization,
  2. participation in a competition organised or managed by a sports organisation or other legal entity authorised by it to organise or manage a competition;
  3. participation in the organization or management of a competition by a sports organization or other legal entity authorized by it to organize or manage a competition,
  4. registration as a sports organization,
  5. the national sports team,
  6. membership or volunteer relationship with a sports organization,
  7. a contractual relationship with a sports organization, the subject of which is a sports activity, if it is an athlete or a sports expert,
  8. participation in the management and administration of a sports organisation;
by participating in the preparation for the competition and in the competition as the accompanying staff of the athlete or team,affiliation to another sports organization that is a member of a sports organization,

b) a definition of what the complaint is directed against and what the submitter is seeking, with an indication of the provisions of the Sports Act, the internal regulations of the sports organization, or other generally binding legal regulations to which the submitter points out.
c) complete available documentation/evidence for the complaint in the form of an annex
